New Jersey Heating Oil Sulfur Reduction – July 1, 2014

TRENTON, NJ – FMA members are reminded that the maximum allowable sulfur standard for heating oil sold in New Jersey is being reduced to 500ppm effective July 1, 2014. The standard will be further reduced to 15ppm on July 1, 2016.
FMA has been asked what about fuel in inventory prior to the effective dates? NJDEP regulations allow for the sale and use of non-conforming fuels after these dates provided they were stored in New Jersey prior to the effective date.
Specifically, N.J.A.C. 7:27-9.2 (a) allows for fuel that was stored in New Jersey prior to the effective date to be sold after the effective date and N.J.A.C. 7:27-9.2 (b) allows for fuel to be used after the effective date provided it was stored in New Jersey prior to the effective date. It is important to note that the requirement is that the fuel was stored in New Jersey prior to the effective date. This means that you would not be able to import fuel or use fuel that is imported after these dates.
